Juvenile delinquency mediation is a restorative process designed to address conflicts involving youth in a way that emphasizes accountability, communication, and problem-solving rather than punishment alone. These mediations are typically referred by the juvenile courts and may involve the youth, parents or guardians, victims (when appropriate), attorneys, probation officers, and other stakeholders.
The goal is to help the young person understand the impact of their actions, provide those affected with an opportunity to be heard, and develop a constructive plan for moving forward. Agreements may include restitution, apologies, behavioral expectations, community service, counseling, educational goals, or other individualized solutions that promote rehabilitation and reduce the likelihood of future involvement with the justice system.
In many court-referred cases, if all parties reach an agreement and the juvenile successfully fulfills the agreed-upon terms, the court may dismiss the delinquency petition without the matter proceeding to trial. In many jurisdictions, this also allows the juvenile record related to the matter to be sealed or otherwise handled in accordance with applicable juvenile confidentiality laws. Because every case is different, final disposition remains within the discretion of the juvenile court.
